Terms and Conditions of Footage Ownership for Videography and Photography Services
1. Ownership of Footage
All footage, including videos, photographs, and raw files, created by This Digital Ltd trading as Dronergram remains the sole property of This Digital Ltd trading as Dronergram unless otherwise agreed in writing. The client is granted a license to use the footage as outlined in the agreement or invoice for the project.
2. Licensing and Usage Rights
Upon full payment, the client is granted a non-exclusive, non-transferable license to use the footage for the specific purposes outlined in the project agreement (e.g., marketing, social media, website content). Any usage beyond the agreed purposes requires additional licensing and fees.
3. Raw Footage
Raw footage, unless specifically included in the agreement, remains the property of This Digital Ltd trading as Dronergram. Requests for raw footage must be agreed upon before the job commences. If required, raw footage will be uploaded to This Digital Ltd trading as Dronergram’s Google Drive server for client review and stored for a maximum of 14 days. During this time, the client can download the files. After 14 days, the footage will be permanently removed from the server unless an alternative arrangement is agreed upon in writing.
4. Attribution
This Digital Ltd trading as Dronergram retains the right to use the footage for promotional purposes, including portfolio displays, website content, social media, and marketing materials, unless explicitly stated otherwise in writing by the client.
5. Copyright Protection
All footage created by This Digital Ltd trading as Dronergram is protected under copyright law. Unauthorized reproduction, resale, distribution, or modification of the footage without prior written consent is strictly prohibited.
6. Third-Party Use
Clients may not transfer, sell, or sub-license the footage to any third party without prior written approval from This Digital Ltd trading as Dronergram. Any third-party use will require a separate agreement and licensing fee.
7. Alterations
Clients may not alter or edit the footage in any way that misrepresents the original intent or quality of the content without prior approval from This Digital Ltd trading as Dronergram.
8. Payment Terms
Ownership of licensed footage and usage rights will only be granted upon receipt of full payment for the project as outlined in the invoice or agreement.
9. Liability
This Digital Ltd trading as Dronergram is not liable for any misuse or unauthorised distribution of the footage once provided to the client.
10. Storage of Footage on Google Drive
If raw footage is requested for review, this must be agreed upon before the job commences. The footage will be uploaded to This Digital Ltd trading as Dronergram’s Google Drive and made available to the client for download for a maximum of 14 days. After this period, the files will be permanently removed from the server. It is the client’s responsibility to download and store the files within this time frame. Additional storage requests beyond this period may incur extra charges and must be agreed upon in writing.
11. Disputes
Any disputes related to ownership or usage of the footage will be governed by the laws of the United Kingdom, and both parties agree to resolve any disputes in accordance with these terms.
